Terms of Service

The friendly fine print, in plain language. These Terms cover how you can use EduGato, what we expect from you, and the commitments we make in return.

1. Acceptance of terms

By creating an account, signing in with a third-party provider, or otherwise accessing or using EduGato (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and that organization. If you do not agree with any part of these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 13 years old to create an EduGato account. If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian, and that adult must agree to these Terms on your behalf. We may require age verification at any time and may suspend accounts that we reasonably believe do not meet this requirement.

3. Your account

Your EduGato account is personal to you. You are responsible for the activity that happens under your account, including any content uploaded, messages sent, and purchases made.

  • Provide accurate, current, and complete information when you register — including your real name, a working email address, and any required identity details. If anything changes (email, billing address, organization affiliation), update it from your settings within 30 days so we can keep your account secure and reachable for legal, billing, and support communications.
  • Choose a strong, unique password (we recommend at least 12 characters mixing letters, numbers, and symbols) and keep it confidential. EduGato will never ask you to share your password by email, chat, or phone. We strongly encourage enabling two-factor authentication once it is available in your account settings.
  • Notify us immediately at hello@edugato.app if you suspect unauthorized access, see unfamiliar activity in your dashboard, or notice unexpected charges. Acting fast helps us lock the account, revoke active sessions, and reverse any damage before it spreads to your courses, certificates, or billing.
  • Do not share, sell, transfer, sublicense, or otherwise dispose of your account credentials to any third party. Each EduGato account is tied to one human, and pooled access (one login used by an entire team or class) is not allowed — organizations should use the dedicated organization workspace instead.
  • We may suspend or close accounts that repeatedly violate these Terms, abuse other users, generate fraudulent payments, or pose a measurable security risk to the platform. Whenever it is safe and legally appropriate, we will notify you in advance and give you a reasonable window to fix the issue or appeal the decision.

4. Acceptable use

EduGato is built for learning, sharing knowledge, and respectful interaction. To keep the platform safe and useful for everyone, you agree not to:

  • Upload, post, or distribute content you do not own or have explicit, demonstrable permission to share. This includes copyrighted videos, articles, images, audio tracks, course materials, and quiz questions sourced from third parties — even when used in good faith. If you cannot point to a license, written permission, or your own original work, assume the content is not yours to share on EduGato.
  • Engage in harassment, hate speech, threats, stalking, doxing, or any behaviour that targets a person or group based on race, ethnicity, religion, gender, sexual orientation, disability, age, or any other protected characteristic. This rule applies to comments, direct messages, profile content, course descriptions, and any other surface where you can communicate with other users.
  • Attempt to access another user's account, scrape the platform at scale, run automated bots, send brute-force requests, or otherwise interfere with normal Service operation. Light personal automation for accessibility (screen readers, keyboard helpers, reasonable use of public APIs once published) is welcome and explicitly excluded from this restriction.
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, proprietary algorithms, ML models, or training data behind the Service, except where this restriction is expressly prohibited by applicable law (for example, decompilation strictly required to ensure interoperability under EU directive 2009/24/EC).
  • Use the Service to generate, store, or distribute spam, phishing content, malware, deepfakes intended to deceive, illegal content, or anything that violates the export-control or sanctions laws of Algeria, the European Union, or the United States. We reserve the right to remove such content immediately and to report serious violations to the relevant authorities.
  • Misrepresent your identity, affiliation, qualifications, or course outcomes, including impersonating another EduGato user, instructor, employer, or member of our staff. Inventing fake reviews, certificate scores, or testimonials about your own courses is also prohibited and will lead to suspension.

5. User content & intellectual property

You keep full ownership of any content you upload to EduGato — your videos, audio, text answers, profile images, and creator-built courses ("User Content"). By uploading User Content, you grant EduGato a worldwide, royalty-free, non-exclusive license to host, store, reproduce, transcode, display, and distribute that content within the Service for the purpose of operating, improving, and promoting EduGato.

  • You can delete your User Content at any time from your creator dashboard or learner profile. Once deleted, public access stops within minutes; encrypted backups may persist for up to 30 days strictly for disaster-recovery purposes before being permanently removed from cold storage. We will never restore deleted content for marketing or training purposes.
  • EduGato's brand, logos, illustrations (including the cat mascot and all character artwork), source code, lesson templates, quiz patterns, AI prompts, and the Service itself are the intellectual property of EduGato and protected by copyright, trademark, and trade-secret law. You may not copy, mirror, or repurpose them outside of normal product use without our prior written consent.
  • If you believe content on EduGato infringes your intellectual-property rights, send us a detailed notice at hello@edugato.app including: identification of the protected work, the EduGato URL where the infringing content appears, your contact details, and a statement that the information is accurate to your knowledge. We follow a notice-and-takedown process and will acknowledge your report within 5 business days and resolve it within 14 days where possible.

6. Subscriptions, billing & refunds

Some features (such as Premium streak freezes, advanced AI feedback, certificate downloads, organization seats, and creator analytics) require a paid subscription. Prices, billing cycles, currencies, and renewal terms are displayed at checkout and may vary by country, plan, and the local sales tax that applies to you.

  • Subscriptions renew automatically at the end of each billing period using the payment method on file unless you cancel at least 24 hours before the renewal date. The renewal charge equals the then-current price for your plan, which we will notify you about by email if it has changed since your last renewal.
  • You can cancel any active subscription at any time from Settings → Billing → Manage plan. Cancellation stops the next renewal — your Premium access continues until the end of the period you have already paid for, and we never charge you again unless you re-subscribe yourself.
  • We offer a 14-day, no-questions-asked refund on a user's first paid subscription on EduGato. Email us within 14 days of the original charge with your account email and we will process the refund to the original payment method within 5 business days. After the first 14 days, refunds are reviewed individually based on usage and the reason given.
  • Taxes (VAT, GST, sales tax), exchange-rate fees, and any local payment-network surcharges are charged in addition to the listed price where required by law. The exact breakdown is visible on every invoice in your billing history and follows the rules of your billing-address jurisdiction.

7. Service availability

We work hard to keep EduGato running 24/7, but we do not guarantee uninterrupted access. Scheduled maintenance, infrastructure failures, security incidents, or events outside our reasonable control (such as outages at our hosting providers) may occasionally affect availability. We will make reasonable efforts to communicate planned downtime in advance and to restore Service as quickly as possible after unexpected interruptions.

8. Termination

You can delete your EduGato account at any time from Settings → Account → Delete account. Upon deletion, your access stops immediately and most of your personal data is removed within 30 days (some items may be retained longer where required by law, fraud prevention, or accounting).

  • We may suspend or terminate accounts that materially breach these Terms, expose other users to harm, or create legal risk for the platform.
  • Where possible, we will notify you and give you a reasonable opportunity to cure the breach before suspension.
  • Sections that by their nature should survive termination (intellectual property, indemnity, limitation of liability, governing law) will remain in effect.

9. Disclaimers & limitation of liability

EduGato is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific learning goals, be uninterrupted, secure, or error-free, or that course content is comprehensive or up to date.

  • To the maximum extent permitted by applicable law, EduGato's total liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 100.
  • EduGato is not liable for indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or business interruption — even if we have been advised of their possibility.
  • Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., gross negligence, wilful misconduct, or death or personal injury caused by negligence).

10. Governing law & dispute resolution

These Terms are governed by the laws of Algeria, without regard to its conflict-of-law principles. Before filing any formal legal action, you agree to attempt good-faith resolution by contacting us at hello@edugato.app. Any disputes that cannot be resolved through informal contact will be brought before the competent courts of Algiers, Algeria, unless your local consumer-protection law requires otherwise.

11. Changes to these terms

We may update these Terms occasionally to reflect new features, legal requirements, or operational realities. When we do, we will update the "Last updated" date at the top of the page. For material changes (such as new payment terms or significant changes to user rights), we will notify active users by email and/or in-app notification at least 14 days before the changes take effect. Continued use of EduGato after the effective date means you accept the updated Terms.
